Privacy Policy
Effective and last updated: September 12, 2026
This Privacy Policy explains how Monte Cristo Group and the affiliate operating the website that links to this Policy (collectively, “Monte Cristo,” “we,” “us,” or “our”) collect, use, disclose, and retain personal information when you visit our public website, view embedded media, or communicate with us about our business.
Scope
This Policy applies to personal information collected through Monte Cristo’s public-facing website and through emails or other communications initiated from that website. “Personal information” means information that identifies, relates to, describes, or could reasonably be linked with an individual or household.
This Policy does not apply to information processed within Active Rep, an authenticated customer portal, or another customer-specific product or service unless that product or service expressly links to this Policy. Those environments may involve business records, asset information, activity logs, documents, communications, and account data and should be governed by the privacy notice and contractual terms presented for that service.
This Policy also does not apply to employee or job-applicant records governed by a separate notice, or to third-party websites and services that have their own privacy practices.
Information We Collect
Information you provide
We may collect information you choose to provide when you contact us, ask for information, request a meeting, or discuss a potential business relationship. This may include:
- Your name, email address, telephone number, mailing address, and communication preferences.
- Your company, title, industry, and other professional or business information.
- The content of your message and any information or files you choose to send.
- Information about your interest in Monte Cristo products, GPU infrastructure, computing services, software, facilities, or business opportunities.
- Records of meetings, support requests, transactions, agreements, and related communications if you begin a business relationship with us.
Information collected automatically
When you visit the website, our hosting, security, and embedded-content providers may automatically receive technical information such as your Internet Protocol address, browser type, device type, operating system, referring and exit pages, pages viewed, dates and times of access, general location inferred from your Internet Protocol address, and diagnostic or security events.
Information from other sources
We may receive business contact information from an affiliate, referral source, professional adviser, event organizer, service provider, or publicly available source. We use that information only for legitimate business communications, due diligence, security, compliance, or another purpose described in this Policy.
Please do not send sensitive information through the public website or ordinary email. Do not send Social Security numbers, account passwords, private keys, full payment-card numbers, bank credentials, tax returns, or confidential financial records unless Monte Cristo has provided an approved secure method for doing so.
How We Use Information
We may use personal information to:
- Operate, display, maintain, troubleshoot, and secure the website.
- Respond to questions, schedule meetings, provide requested materials, and communicate about a potential or existing business relationship.
- Evaluate interest in our products and services and improve our website, communications, and customer experience.
- Send business updates or marketing communications when permitted by law. You may opt out of marketing emails at any time.
- Prevent fraud, misuse, security incidents, and other harmful or unlawful activity.
- Comply with law, enforce agreements, establish or defend legal claims, and protect the rights, property, safety, and security of Monte Cristo and others.
- Complete a merger, financing, acquisition, reorganization, sale of assets, or similar business transaction.
Cookies and Embedded Content
Cookies and similar technologies are small files or identifiers used to operate websites, remember settings, protect security, measure performance, or support third-party features. The public website may use technologies that are necessary for hosting, delivery, security, and basic functionality.
HeyGen video
The website includes a video hosted by HeyGen. When the embedded video loads or you interact with it, your browser communicates directly with HeyGen. HeyGen may receive technical and usage information such as your Internet Protocol address, browser and device information, the page or referring address, timestamps, viewing activity, and cookie or local-storage identifiers. HeyGen processes information under its own Privacy Policy.
Your choices
You can use your browser settings to block or delete cookies. Blocking some technologies may prevent embedded media or other features from working properly. Where applicable law requires consent for optional cookies, Monte Cristo will provide the required choice before activating them. If Monte Cristo later adds advertising or optional analytics technologies, we will update this Policy and provide any legally required controls.
Some browsers support “Do Not Track” signals, but there is no uniform standard for responding to them. Where applicable law requires recognition of a universal opt-out signal, such as Global Privacy Control, we will process the signal as required.
How We Disclose Information
We may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described above:
- Service providers. Website hosting, content delivery, cybersecurity, information technology, communications, customer support, document management, and other vendors that perform services for us.
- Embedded-content providers. HeyGen and any other provider whose content you choose to load or use through the website.
- Affiliates and business partners. Monte Cristo affiliates and partners involved in responding to an inquiry, evaluating a proposed relationship, or providing a requested product or service.
- Professional advisers. Attorneys, accountants, auditors, insurers, lenders, and other advisers subject to professional or contractual obligations.
- Government authorities and other parties. Recipients when disclosure is required by law or reasonably necessary to protect rights, safety, security, property, or the integrity of our services.
- Transaction participants. Actual or prospective buyers, investors, lenders, advisers, and counterparties in connection with a financing, merger, acquisition, reorganization, bankruptcy, or sale of all or part of a business or its assets.
- Recipients you direct. A person or organization you ask us to contact or with whom you authorize us to share information.
We may also use and disclose information that has been aggregated or deidentified so that it cannot reasonably be linked to you. We will not attempt to reidentify deidentified information except as permitted by law.
Sale and Targeted Advertising
Monte Cristo does not sell personal information for monetary consideration. Based on the public website practices described in this Policy, we do not knowingly disclose personal information to third parties for their own cross-context behavioral or targeted advertising. Information transmitted directly to an embedded-content provider is described in the Cookies and Embedded Content section and may be processed by that provider under its own policy.
If our practices change in a way that gives you a legal right to opt out of a sale, sharing, targeted advertising, or qualifying profiling, we will provide the required notice and method to exercise that right before or when the new practice begins.
Data Retention
We retain personal information only for as long as reasonably necessary for the purpose for which it was collected and for compatible business, security, legal, accounting, or compliance purposes. We determine retention periods based on the nature and sensitivity of the information, the status of the relationship, the time needed to respond to an inquiry, contractual and legal requirements, applicable limitation periods, fraud-prevention needs, and dispute or litigation holds.
Contact and inquiry records are generally kept while we respond and for a reasonable follow-up period. Technical and security records are generally kept for the period needed to operate, diagnose, and protect the website. Records connected with a transaction or business relationship may be retained for the relationship and the period required by applicable law, contract, audit, tax, or dispute-resolution needs. When information is no longer required, we may delete it, deidentify it, or securely isolate it until deletion is practicable.
Data Security
We use administrative, technical, and physical safeguards designed to protect personal information in light of its nature and the risks involved. No website, email transmission, or information system is completely secure, and we cannot guarantee absolute security. You are responsible for using appropriate care when deciding what information to send through email or other public communication methods.
Your Privacy Rights
Depending on where you live and subject to applicable exceptions, you may have the right to:
- Confirm whether we process your personal information and request access to it.
- Request correction of inaccurate personal information.
- Request deletion of personal information.
- Receive certain personal information in a portable format.
- Opt out of a sale, sharing, targeted advertising, or certain profiling.
- Limit certain uses or disclosures of sensitive personal information.
- Withdraw consent when processing is based on consent.
- Appeal a decision regarding a privacy request.
- Receive equal service and pricing without unlawful discrimination for exercising a privacy right.
To submit a request, email info@montecristo.com with the subject line “Privacy Request.” Describe the right you wish to exercise and provide enough information for us to locate the relevant records. We may request additional information to verify your identity and authority. We will use verification information only for that purpose and will respond within the period required by applicable law.
You may authorize an agent to submit a request where permitted by law. We may require proof of the agent’s authority and may ask you to verify your identity directly. If we deny a request and your law provides an appeal right, you may appeal by replying to our decision or emailing the same address with the subject line “Privacy Appeal.”
Additional State Disclosures
U.S. state privacy laws may require disclosure of the categories of personal information collected, sources, purposes, and recipient categories. Depending on how you interact with us, the categories described by those laws may include:
- Identifiers and contact information, such as name, email address, telephone number, mailing address, Internet Protocol address, and online identifiers.
- Customer and commercial information, such as product or service interests, inquiry history, transaction records, and information related to a potential or existing business relationship.
- Internet or electronic activity, such as browser and device information, referral data, pages viewed, interactions, diagnostic data, and security logs.
- Approximate geolocation inferred from an Internet Protocol address.
- Professional or business information, such as employer, company, title, industry, and business contact details.
- Communications and submitted content, such as emails, messages, attachments, meeting records, and support correspondence.
We collect these categories from you, your browser or device, our service providers, affiliates, referrals, business partners, and public sources. We use them for the purposes described in How We Use Information and may disclose them for business purposes to the recipient categories described in How We Disclose Information.
The public website is not designed to collect sensitive personal information. Monte Cristo does not use or disclose sensitive personal information collected through the public website to infer characteristics about an individual. We do not knowingly sell or share the personal information of individuals under age 16.
These state disclosures apply only to the extent a state privacy law covers Monte Cristo and the information at issue. We may deny or limit a request when an exception applies, including when records concern a person acting in a commercial capacity and the applicable law excludes business-to-business information.
Children
The website is intended for adults and business users and is not directed to children. We do not knowingly collect personal information from children under 13 through the public website. If you believe a child has provided personal information to us, contact us so we can investigate and take appropriate action.
International Visitors
Monte Cristo is based in the United States. If you access the website from another country, your information may be processed and stored in the United States or another location where we or our providers operate. Those locations may have privacy laws that differ from the laws where you live. Where required, we will use an appropriate legal basis and transfer mechanism.
Changes to This Policy
We may update this Policy to reflect changes in our website, data practices, providers, or legal obligations. We will post the updated version and revise the effective date above. If a change materially affects how we use personal information already collected, we will provide any additional notice or choice required by law.
